Sun Mark Properties has agreed to remove the partially installed 6-ft. fence, replacing it with a lower 4-ft. fence in order to be in compliance with the Whatcom County Shoreline Management Plan. This will meet the shoreline exception criteria. Whatcom County has issued an “Exemption Letter” limiting the fence height to a maximum of 4-ft., requiring a minimum of a 5-ft. opening for pedestrian access. To meet the fire department permit requirements, a 20-ft. opening will be required for the electronic gate and a gate access key must be provided to South Whatcom Fire.
